NZSALE sentenced for selling unsafe nightwear

NZSaleOnline retailer NZSALE has been fined NZ$74,000 after pleading guilty to four charges for failing to meet applicable safety standards for nightwear the company sold.

The company was sentenced in the North Shore District Court earlier this week under the Fair Trading Act, due to flammable material being used in conjunction with insufficient fire hazard labelling.

“These products are the subject of regulation to protect children form the risk of fire which can result in severe disfiguring injuries or worse,” Judge Cunningham said.

The NZSALE sentencing is but the latest in a string of such cases spearheaded by the Commerce Commission, Commissioner Anna Rawlings said.

“It is important that retailers understand and comply with safety standards – especially when babies and young children are concerned,” Rawlings said.

“Parents should check the labelling of clothing so they are aware of the safety and suitability of children’s nightwear when using heaters or fires.”

The retailer was initially charged in May after selling 73 unsafe units of clothing, with only eight returned through a product recall and a further 15 confirmed destroyed by consumers.
